Course information

The Mental Capacity Act & Deprivation of Liberty Safeguards training course is applicable for anyone working with vulnerable adults, particularly in healthcare, residential, or community settings, where individuals may be unable to make certain decisions due to conditions like dementia or mental health issues. Participants will learn how to assess mental capacity, make best-interest decisions, and ensure compliance with DoLS to protect individuals' rights and prevent unlawful deprivation of liberty.

This MCA & DoLS training course is mapped to HSC 024 (Principles of safeguarding and protection in health & social care) and covers such topics as:

  • Explain the purpose, scope, and key principles of the Mental Capacity Act (MCA) 2005

  • Define mental capacity and describe the legal criteria for assessing it

  • Describe the role and legal protections provided by Sections 5 and 6 of the MCA

  • Explain the function and powers of the Court of Protection, Lasting Powers of Attorney (LPA), and Independent Mental Capacity Advocates (IMCA)

  • Understand the purpose and process of the Deprivation of Liberty Safeguards (DoLS)

  • Outline the steps for DoLS applications, authorisations, reviews, and appeals

  • Maintain accurate records of capacity assessments, decisions, and authorisations to meet legal and best practice standards
